Terms & Conditions

  1. In these conditions the expression ‘The Company’ shall mean Abbey Glass (Derby) Ltd / Burton Glass and the expression ‘The Purchaser’ shall mean the customer whose name appears on the printed form of which these conditions form part.
  2. The Company agrees to sell to the Purchaser and install all goods detailed on the front of this agreement at the stated address.
  3. Delivery Period: The Company will make every effort to meet the approximate delivery period but shall not be held responsible for delays caused by unforeseen circumstances. If the work is not completed within the delivery period stated, the Purchaser may serve notice in writing requesting that the work be completed within a reasonable timeframe (typically six weeks is considered reasonable). If the work is still not completed within the extended period, the Purchaser may cancel the outstanding work covered by the contract without penalty by providing written notice. However, The Company shall not be liable for delays caused by factors beyond its reasonable control. Time shall not be considered of the essence during any such delays. The Purchaser shall grant The Company reasonable access to the premises for taking measurements, fulfilling the contract, or completing any remedial work. The Company is not liable for any consequential losses, including but not limited to loss of earnings.
  4. Payment Terms: 25% deposit, on all orders, the remainder to be paid as per quotation. Interest on overdue accounts will be charged at 4% above the current bank base rate.
  5. Contract Cancellation: This contract is binding unless:
    a) Following a survey, a satisfactory installation is not possible. b) The contract was signed away from The Company’s business premises, in which case the Purchaser has a right to cancel within 14 calendar days from the order date. Cancellation must be communicated in writing and sent via recorded delivery to the Sales Director at Abbey Glass (Derby) Ltd, Wetherby Road, Ascot Drive, Derby, DE24 8HL. A right to withhold the 25% deposit may be invoked if the works up to the termination point are non-refundable.
  6. Condensation Disclaimer: While The Company will strive to reduce or eliminate condensation, it cannot guarantee its complete elimination due to various environmental factors
  7. Building Defects: The contract price does not include rectifying defects in the existing building structure that were not apparent prior to installation. Company is not liable for any consequential losses, including but not limited to loss of earnings
  8. Ownership of Goods: Title to all materials remains with
    The Company until payment is received in full.
  9. Redecoration: While The Company will aim to minimise disruption during installation, any required redecoration remains the responsibility of the Purchaser.
  10. VAT Adjustments: Any change in VAT rates implemented after the date of the order will be passed on to the Purchaser.
  11. Samples and Modifications: Showroom samples and brochures are for illustrative purposes only. Items listed in the schedule will be measured and manufactured as deemed appropriate by The Company. Minor product modifications may be made as part of continuous improvement. Major modifications will require a new contract and a fresh cooling-off period.
  12. Glass Quality: All glass used is of high quality, but manufacturers do not guarantee against minor imperfections. The Company is not responsible for such imperfections or for any glass breakages after installation.
  13. Warranty and Guarantees: We guarantee all PVCu product for 10 years, Glass Units and Hardware for 5 Years. All other products & electrical appliances are covered by the manufacturer’s guarantee.
  14. Industry Standards: The Company supports the GGF Code of Good Practice and adheres to guidelines set by the Glass and Glazing Federation. For more details, visit:

  15. Maintenance Requirements: Frames and profiles require regular maintenance and cleaning (refer to the maintenance guide). As with all external products, natural weathering may occur over time. Failure to follow the maintenance guidelines may affect the warranty.
  16. Building and Groundworks: All conservatories are constructed to the specifications of the Conservatory Association and the Glass and Glazing Federation. The concrete base will be damp-proofed and insulated, typically raised to match the house floor level. Standard foundation depth is 600mm. If deeper foundations are required, The Company will cover up to 1000mm. Depths beyond this will incur additional charges payable by the Purchaser.
  17. Site Facilities: The Purchaser is responsible for providing welfare facilities, access to electricity and water, and space for a skip if required.
  18. Data Protection: The Company will handle all personal data in accordance with the UK General Data Protection Regulation (GDPR). Personal data will only be used for contract fulfilment and legal obligations and will not be shared with third parties without consent, except where required by law.
